Notwithstanding anything to the contrary in this clause or agreement it is expressly agreed that the OWNER will have no liability whatsoever for the death or personal injury, howsoever caused, to any employee or servant of the CONSULTANT for whom such insurance was or should have been in place, whether death or injury arose whilst the employee of the CONSULTANT was acting outside the scope of his employment contract, or not.
