这个帖子主要是讨论压载水处理装置,而不是讨论压载水置换的情况。因为过了过渡期,从2024年9月8日以后,压载水处理装置就是强制了。
A . IMO (1)和USCG (2)对于压载水的定义,基本一样。
(1.) Ballast Water" means water with its suspended matter taken on board a ship to control trim, list, draught, stability or stresses of the ship.
(2).Ballast water means any water and suspended matter taken on board a vessel to control or maintain, trim, draught, stability, or stresses of the vessel, regardless of how it is carried.
IMO (1)和USCG (2)对于压载舱的定义,有不同,IMO强调作用,USCG强调的是只要装压载水的处所
1)Ballast Water Capacity" means the total volumetric capacity of any tanks, spaces or compartments on a ship used for carrying, loading or discharging Ballast Water, including any multi-use tank, space or compartment designed to allow carriage of Ballast Water
2)Ballast tank means any tank or hold on a vessel used for carrying ballast water, whether or not the tank or hold was designed for that purpose.
B. 关于列外情况(exception 而不是免除 (Exemption)MO (1), USCG (2),请注意: 列外情况,是不需要免除的,因此不需要船旗国同意的。我发帖子的目的,就是想咨询下风暴压载是不是属于 IMO里面的 第一种情况 。I。 USCG没有这exeption 的条列,只有免除。
(1).The requirements of regulation B-3, or any measures adopted by a Party pursuant to Article 2.3 and Section C, shall not apply to:
1 the uptake or discharge of Ballast Water and Sediments necessary for the purpose of ensuring the safety of a ship in emergency situations or saving life at sea; or
2 the accidental discharge or ingress of Ballast Water and Sediments resulting from damage to a ship or its equipment:
.1 provided that all reasonable precautions have been taken before and after the occurrence of the damage or discovery of the damage or discharge for the purpose of preventing or minimizing the discharge; and
.2 unless the owner, Company or officer in charge wilfully or recklessly caused damage; or
3 the uptake and discharge of Ballast Water and Sediments when being used for the purpose of avoiding or minimizing pollution incidents from the ship; or
4 the uptake and subsequent discharge on the high seas of the same Ballast Water and Sediments; or
5 the discharge of Ballast Water and Sediments from a ship at the same location where the whole of that Ballast Water and those Sediments originated and provided that no mixing with unmanaged Ballast Water and Sediments from other areas has occurred. If mixing has occurred, the Ballast Water taken from other areas is subject to Ballast Water Management in accordance with this Annex
C. 关于免除情况。(exemption),IMO (1) , USCG (2)
(1)
1 granted to a ship or ships on a voyage or voyages between specified ports or locations; or to a ship which operates exclusively between specified ports or locations;
.2 effective for a period of no more than five years subject to intermediate review;
.3 granted to ships that do not mix Ballast Water or Sediments other than between the ports or locations specified in paragraph 1.1; and
.4 granted based on the Guidelines on risk assessment developed by the Organization.

Any Department of Defense or Coast Guard vessel subject to the requirements of section 1103 of the Nonindigenous Aquatic Nuisance Prevention and Control Act, as amended by the National Invasive Species Act; or any vessel of the Armed Forces, as defined in the Federal Water Pollution Control Act (33 U.S.C. 1322(a)), that is subject to the “Uniform National Discharge Standards for Vessels of the Armed Forces” (33 U.S.C. 1322(n)). (2) Any warship, naval auxiliary, or other vessel owned or operated by a foreign state and used, for the time being, only on government non-commercial service. However, such vessels should act in a manner consistent, so far as is reasonable and practicable, with this subpart. (b) Crude oil tankers engaged in coastwise trade are exempt from the requirements of §§151.2025 (ballast water management (BWM) requirements), 151.2060 (reporting), and 151.2070 (recordkeeping) of this subpart. (c) Vessels that operate exclusively on voyages between ports or places within a single COTP Zone are exempt from the requirements of §§151.2025 (ballast water management (BWM) requirements), 151.2060 (reporting), and 151.2070 (recordkeeping) of this subpart. (d) The following vessels are exempt only from the requirements of §151.2025 (BWM requirements) of this subpart: (1) Seagoing vessels that operate in more than a single COTP Zone, do not operate outside of the EEZ, and are less than or equal to 1,600 gross register tons or less than or equal to 3,000 gross tons (International Convention on Tonnage Measurement of Ships, 1969). (2) Non-seagoing vessels. (3) Vessels that operate in more than a single COTP Zone and take on and discharge ballast water exclusively in a single COTP Zone.
因为美国没有批准BWM 公约,他提出来3种处理方式。 1. 安装USCG认可的 压载水处理装置 2. Use only water from a U.S. public water system (PWS) ,但是装之前对于压载舱的处理有要求,比如洗舱。 3. Perform complete ballast water exchange in an area 200 nautical miles from any shore prior to discharging ballast water 。或者是有IMO 认可的压载水处理装置 这个简称 (AMS),但是最后这个是肯定要被USCG认可的取代。
关于14楼的情况,说USCG可以说允许12海里可以排和风暴压载可以列外,真不知道从哪儿来的,请教! 但是。关于我说的MAPRPOL I 18.3.2 情况的情况可以作为列外(Exeption) ,我是在看CCS关于压载水公约指南看到的。但是同一个个条款下就是关于恶劣情况(18.3.1),CCS没有作为列外条件。 所以,我大胆推测了,风暴压载舱的压载水是必须要经过压载水处理装置处理的。由于前面提到IMO 里面的一种例外情况 ( the uptake or discharge of Ballast Water and Sediments necessary for the purpose of ensuring the safety of a ship in emergency situations or saving life at sea;),风暴压载如果属于应急情况,就是与列外情况了。
所以,二种情况都可能对的,所以,发了这个帖子。
对于14楼说的那个几个会议,特别是MEPC69/4/12。 ,请写写完整,我会去查询的。我在最新的rulefinder 里面没有找到。
至于船旗国豁免之类的,我就不要14楼交流,我经常干这些事情的。
大家对于我提出的疑问,请帮帮忙找找。
对了,我最近你看到一种压载水处理装置,是通过打惰气,这样排载 就可以直接排,不要再次通过压载水处理装置了。
根据14楼的回复,我感觉 牛逼的“青语”,把压载水污染和油污染混淆了,如果这样,他根本没有理解我发这个18.3.2的目的。这样,就太可悲了。没事,到厕所自己打自己三个耳光。我可以原谅你。
